Demand a New Trial for Mumia Abu-Jamal

We scholars and students of Africa demand a new trial for Mumia Abu-Jamal.

The death penalty meted out to Mumia Abu-Jamal has much relevance for
scholars and students of Africa.

Mumia Abu-Jamal's case fits a well known pattern: for over 400 years
Africa and her descendants have been subject to criminal injustice.

In his 1982 trial, Abu-Jamal was assigned an unprepared attorney, denied
the right to defend himself, banished from the courtroom, and judged by
jury of his non-peers. The trial judge was well known as a hanging judge:
he thus sentenced Abu Jamal to death, as he has done 33 others--all but
two being persons of color. Subsequent appeals containing evidence of
intimidation of witnesses, false testimony, and fabricated confessions
have had to be presented to the same judge. They have thus been denied.

Daughters and sons of Africa have known such "justice" far too often, for
far too many centuries.

We can do nothing less than join those demanding an end to the death
penalty in this country and a new trial for Mumia Abu-Jamal, and we urge
everyone to do the same.

Hello ya'll

This is just tell ya'll that this starting on Monday the 22nd of
November, I will be doing a fast for Mumia Abu Jamal for not less than 3
days and not more than about 12 days. This is a good opportunity for me
to see how passionate I really am about this, and so I can determine how
much my heart cares. It would be awesome if any of you could join me in
for as long as you would like, a day, two, anything would be awesome.
Last May I did a 48 hour fast without water, so this time I will be
drinking water which will make it a little easier. Note a fast is
something drastic yes, but clearly within the parameters of all legality
and rules. Please do not worry anyone, as long as I drink adequate water
I will be fine, people can go days and days without food as long as they
have water. Also, I am a very healthy person, so this will be beneficial

Federation Without Television has a booth reserved for Monday to Wednesday
so it appears as if us progressive orgs have another corner on the booth
market for this upcoming week. This booth will be in part to spread the
news of Mumia Abu Jamal and my action and also of course to disseminate
kick ass propgandha.

PELTIER'S LIFE: A SUN DANCE

When one makes mere mention of the Pine Ridge Reservation, another
name immediately leaps to mind: Leonard Peltier. Known among his clan as
"Gwarth-ee-lass" (He Leads the People) his life and case have become
international symbols of the rampant injustice faced by Indians in the
United States of America.
For over a quarter of a century, Peltier has been encaged in U.S.
dungeons, beaten, framed, and maltreated; but he remains unbroken.
Now, after many long continuing years in hell, Peltier has penned a
moving, heart-rending account of his life, showing his growth and
development as a political activist, and his continuing faith in the
rightness of his cause, and the rightness of the Indian Way. The
newly-published book is entitled Prison Writings: My Life Is My Sun Dance
(N.Y. : St. Martin's Press, 1999). For those who may know his name but know
little of the events leading up to his political incarceration. His
introduction, as a youth, to the ways of the white man virtually insured his
political future of resistance:

After Gramps died of pneumonia when I was eight, life became
really hard for us. My grandmother was left alone. She spoke hardly any
English, had almost no income, and was trying to raise three small kids-me,
my sister, and our cousin Pauline. I tried stacking the table with my
slingshot, coming up with an occasional squirrel or maybe a small bird;
mostly Gamma used them to flavor the otherwise vegetarian soup. I never
could seem to catch a rabbit with my slingshot, like the big fat ones Gramps
had gotten now and then with his single shot .22 for Gamma's beloved rabbit
stew.
Given the cold North Dakota winters, hunger became a really
big problem for us. We had no bread, no milk, hardly anything else. I
thought that gnawing ache in my belly was just the way I was supposed to
feel.
One day in the fall of 1953, a big black government car came
and took us kids away to the Bureau of Indian Affairs boarding school in
Wahpetan, North Dakota. I remember Gamma weeping in the doorway as she
watched them take us off. We had no suitcases, just bundles. First thing
after we got there, they cut off our long hair, stripped us naked, then
doused us with powdered DDT. I thought I was going to die. That place, I
can tell you, was very, very strict. It was more like a reformatory than a
school. You were whacked on the butt with a yardstick for the smallest
infraction, even if you so much as looked someone in the eye. [pp. 77-78.]

For young Leonard, what should have been a school was considered "my
first imprisonment." His crime? Being an Indian.
This was a little boy's introduction to the American Way, where he
and his people were beaten for speaking the language of their mothers and
fathers. Where they were punished for not acting white enough.
Is there any wonder that he would later find the Indian Way a better
way of life?
This is a remarkable portrayal of Native American history, and
reveals the reasons why there is still so much bad blood between the
aboriginal peoples of this country and the Americans.
Peltier's life is a tortured one, and the tactics used by the U.S.
government are almost unbelievable in their crudeness, and their cruelty.
Learn about one of the nation's most brutal tragedies, and the
spirit that remains filled with hope in the name of Crazy Horse.
There is undoubtedly Indian history written in these pages by a
remarkable man; it is also American history, of a kind not taught in the
pages of American history books, yet lived by millions.
Every school child should read this book. In this way they will
finally begin to learn the truth about the last 500 years in this place we
call America.
Perhaps their voices can join the growing, swelling chorus of the
many calling for the freedom of this ailing spiritual warrior, guilty only
of daring to be Indian in a nation where red people weren't really supposed
to survive.

U.S. State Department Lies About Mumia Abu-Jamal

In response to inquiries by Austrian trade unionists about the case of Mumia
Abu-Jamal, the U.S. Embassy in Austria responded on November 10, 1999, with
a written summary of the case prepared by the State Department. According to
the cover letter signed by political officer Katherina Gellner-Sweet, “Mr.
Abu-Jamal’s case has been thoroughly reviewed by numerous judicial bodies,
as well as by the United Nations. All have concluded that his legal rights
were not violated.”

The attached document demonstrates at best a complete lack of knowledge, and
at worst a deliber-ate attempt to misrepresent the truth in the case. It
makes charges against Mumia that even the Philadelphia authorities do not
make, such as claiming that Mumia “fired upon arresting officers.” It also
claims that Mumia’s case has been ruled on by the Federal courts, and that
United Nations bod-ies have found his case to be without merit. In reality,
no U.S. federal court nor any United Nations body has ever ruled on the
merits of Mumia’s case.

What follows is the text of the case summary authored by the U.S. State
Department:

Facts of the Case:

On July 3, 1982 Mr. Abu-Jamal was sentenced to death by a jury in the Court
of Common Pleas in Philadelphia for murdering a police officer on December
9, 1981. He was tried and convicted under the laws of the State of
Pennsylvania.

According to evidence presented at his trial, when his brother was stopped
by a Philadelphia Police Officer, Mr. Abu-Jamal approached the officer from
behind and shot him in the back. The wounded officer managed to return fire
once in self-defense then fell to the ground. The officer’s shot struck Mr.
Abu-Jamal but failed to stop him from advancing. Mr. Abu-Jamal then stood
over the fallen officer and shot him fatally in the head. Furthermore, Mr.
Abu-Jamal attempted to shoot at the arresting officers when they arrived at
the scene. The evidence against Mr. Abu-Jamal included testimony from four
eyewitnesses to the murder and the recovery of the murder weapon, which was
owned and regis-tered to Mr. Abu-Jamal.

According to numerous Federal and Pennsylvania State Appellate Court
decisions, Mr. Abu-Jamal’s trial was conducted fairly and his sentencing and
conviction were compatible with his constitutional rights. Because Mr.
Abu-Jamal was sentenced to death he was guaranteed an appeal to the Su-preme
Court of Pennsylvania, which ruled in 1989 to uphold his conviction. In
1995, Mr. Abu-Jamal appealed his conviction under the Pennsylvania
Post-Conviction Relief Act. However, the Philadel-phia Court of Common Pleas
and the Pennsylvania Supreme Court denied his petition.

Mr. Abu-Jamal alleges that he is the victim of a racist American judicial
system. Extensive appeals procedures in the Commonwealth of Pennsylvania and
the U.S. Federal Court System guarantee all persons charged with a (sic)
offense due process and a fair trial. These protections are afforded all
those sentenced to the death penalty to ensure that their punishment is
neither arbitrary nor dispro-portionate. Mr. Abu-Jamal has appealed this
conviction and sentence at state and federal levels. The legality of his
trial and conviction have been reconsidered several times through the
appeals process, and the conclusion has been reached each time that his
legal rights were not violated. The courts have consistently rejected the
questions he raised concerning that he was not provided with funds necessary
to conduct an investigation, that he was denied the right to represent
himself and that his court-appointed attorney counsel was ineffective, and
that African-Americans were excluded from the jury.

Mr. Abu-Jamal also alleges that he was framed by the Philadelphia Police and
the FBI. This allega-tion does not square with the fact that he was
apprehended at the scene of the crime, and fired upon arresting officers, in
the presence of eyewitnesses. He has not provided any additional evidence to
support his allegation.

Mr. Abu-Jamal’s case is still pending. Mr. Abu-Jamal has exercised his
constitutional right to writ of habeas corpus in the Federal Court System.
On October 26, 1999 a federal judge in Philadelphia granted a stay on his
December 2, death warrant.

The case of Mr. Abu-Jamal has also been raised at the UN Commission on Human
Rights and with the UN Special Rapporteur on Summary, Arbitrary, and
Extrajudicial Punishment several times, and in all cases the UN Human Rights
Mechanisms have found that his allegations were found to be with-out merit
and that he had not exhausted all of his remedies under U.S. law.

Close to 100 community activists participated in a unity rally for for
Mumia Abu-Jamal and Leonard Peltier in Olympia, Washington last
Saturday, November 13th. Drenching rains may have reduced the numbers of
protesters but not the spirits and commitment of those gathered in
Sylvester Park calling for justice and freedom for Mumia and Leonard..

Media arrived to find protesters dancing in unison to the music of South
Sound reggae and jazz artists with Inner Soundz Massive, who performed a
special set incorporating the words of Mumia Abu-Jamal.

Rally speakers included Arthur Miller of the Northwest Leonard Peltier
Defense Committee, Grace Cox of the Olympia Mumia Defense Committee,
and other community activist who have been working on Mumia's and
Leonard's freedom.. They told the story of Mumia and Leonard's unjust
imprisonment and called for support to free all U.S. political
prisoners. Letters supporting executive clemency for Leonard were
signed, as well as letters supporting an evidentiary hearing for Mumia.

The rally was followed my a march through the Olympia downtown area.
Later that evening, other community members attended a teach-in, which
included a showing of "A Case for Reasonable Doubt", concerning Mumia's
case.

The Olympia Mumia Defense Committee holds meetings every Thursday, 7 PM,
at the Bread and Roses kitchen, downtown Olympia. Olympia supporters
are gearing up for WTO protests in Seattle which will include actions
demanding justice and freedom Mumia. We are also planning events that
will inform the greater Olympia community about Mumia's case, including
music events, and teach-ins at the schools and churches. There is also
strong interest and recent movement towards building coalition with
Seattle and Portland supporters for a NW regional protest. Interested NW

Detroit Mumia Demonstration Demands Evidentiary Hearing in Federal Court

DETROIT, 18 Nov. (PANW)--Supporters of Mumia Abu-Jamal, a broadcast
journalist and Black Panther, held an informational picket line at the
Federal Court Building in downtown Detroit demanding that Federal Judge
William H. Yohn, Jr. grant an evidentiary hearing for the death row inmate
in Pennsylvania.

Over 60 people who attended the demonstration chanted slogans, distributed
leaflets and held banners supporting the effort to gain a new
trial for Jamal, who was convicted in the killing of white police officer
Daniel Faulkner on December 9, 1981. Jamal has always maintained his
innocence and is seeking legal exoneration for a crime in which he said he
was not responsible for carrying out. His case has gained international
attention in several countries throughout the world.

Fred Vitale of the Detroit area Labor Party, announced a new campaign to
collect signatures of support from trade unionist at the plant gates. The
effort is slated to begin next month and represents a continuing effort by
the Labor Party and other organizations to increase trade union support
for the movement to gain the overturning of Jamal's 1982 murder
conviction.

Jerry Goldberg of the Workers World Party spoke about an upcoming rally on
Jan. 17 at New Bethel Baptist Church on the city's west side that will
support Mumia's current appeal in Federal Court. The event is being held
on the federal Martin Luther King, Jr. holiday celebrated annually since
1986. "This will be a great opportunity to bring more people into the
struggle to free Mumia," said Goldberg. "We must make Mumia's name a
household word throughout the country," he continued.

The Detroit Coalition is also organizing to send a delegation to Chicago
for a regional demonstration in Chicago on Dec. 11. Other efforts include
a mass leafleting campaign at the local Thanksgiving Day Parade on
Thursday.*

unanimously to declare Mumia Abu-Jamal second citizen of honour of the
commune, after Nelson Mandela. The Mayor, Claudine Cordillot
(French Communist Party -- PCF), recently elected, has contacted the
governor of Pennsylvania to inform him of her intention of going to the
prison where Mumia Abu-Jamal, African American journalist, sentenced
to death, has been locked up since 1982, to present this distinction to him.

Community radio demands justice for Mumia Abu-Jamal

(AMARC/IFEX) - AMARC joins in international solidarity in demanding a fair
trial for US political prisoner, Mumia Abu-Jamal, recently granted a stay of
execution on the death warrant issued for 2 December 1999.

According to Jamal News Service, Federal Judge William H. Yohn, Jr. granted
a stay of execution for Jamal in the Eastern District Court of Pennsylvania.
The stay was granted thirteen days after Governor Ridge of Pennsylvania
signed Jamal's death warrant and will last until the end of the proceedings
in Federal District Court.

On 15 October, the defendant's lawyers filed a habeas corpus petition of 150
pages citing some thirty violations of the American constitution that
occurred in Jamal's trial and appeal.

The stay entitles Jamal to be released from the Phase Two area of the state
correctional institute, Greene County, where he was sent when his death
warrant was signed on 13 October. In Phase Two, Jamal has been under 24-hour
surveillance, subjected to strip searches, a cell with lights on 24 hours a
day, and limited to only one book. Jamal was not allowed any visitors
outside his immediate family and attorneys. Jamal will now return to death
row and await further proceedings before Judge Yohn.

The Philadelphia and Pennsylania Bar Associations' recently called for a
moratorium on all executions until the state's death penalty system was
proven just. One of the systemic inequalities has to do with racial
prejudice. While 9% of Pennsylania's total population is African-American,
the percentage on death row is 62%, or nearly seven times that of the total
population. This is the largest racial disparity of any state in the United
States, reports Jamal News Service.

Since its creation in 1983, AMARC has worked to promote the democratization
of communications. It fulfills its mandate by fostering cooperation and
exchange among community radio stations throughout the world. The AMARC
General Assembly passed a resolution at its World Conference in 1998 to
support the international movement's work to suspend the death sentence for
Jamal, and to grant him a fair trial.

AMARC member, the Confederation nationale des radios libres (CNRL) brought
the resolution to the table and has been bringing this issue to public
attention internationally for more than ten years. At the announcement of
the death warrant set for 2 December, the CNRL launched an appeal "to refuse
the logic of this crime" and is urging international solidarity to stop the
execution of Jamal.

Jamal, journalist and ex-Black Panther leader, also known as the "voice of

locked in prison for eighteen years, accused of killing a white police
officer in December 1981. He is on death row, condemned as a result of "one
of the most incredible trials in recent history," according to his lawyer,
Leonard Winglass. The defendant has always claimed his innocence. Jamal is
an award-winning writer acclaimed various times for his work denouncing
racism, the death penalty, the penal system, and acts of repression against
previous members of the Black Panther Party.

Jamal also escaped execution on 28 August 1995, achieved with the help of an
unprecedented international mobilization effort ten days before his
scheduled death. AMARC calls for international solidarity again to ensure
the current stay of execution lasts beyond the Federal Court proceedings,
and that Jamal is finally granted a fair trial.

The Millions for Mumia group here in Melbourne Australia, held a rally
last Saturday 13 November. We gathered on the steps of the central Post
Office at noon and then marched off to the American Express office where we
heard several speakers from prisoner rights groups,
socialist groups and trade unions.
The Millions for Mumia group plans to continue meeting to be ready
for further actions.
